How to apply for an ICT work permit in The Netherlands

The ICT permit application in the Netherlands is very interesting for overseas companies that are planning to start a company in the Netherlands and relocate staff to The Netherlands.

There are two different forms for ICT (Intra Corporate Transfer) applications: 

A sponsor is a person or organization having an interest in the residence of a third-country national in The Netherlands. When you engage this foreign employee, you will become the sponsor for the employee.

In some cases, it is obligatory to become a recognized sponsor. Becoming a recognized sponsor also has advantages; for example, the IND will handle your applications faster. More information on becoming a recognized sponsor can be found here

Before the (recognized) sponsor submits the application, the obligated documents and information need to be collected. Foreign documents must be legalized and translated into Dutch, English, French or German.

Recognized sponsor

Before submitting an application for a permit, the necessary documents and paperwork must have been collected. Foreign documents must have been legalized and translated. Bear in mind that this can take some time and it also costs money.

Recognized sponsors need to enclose the following documents with the form: 

• The completed appendix ‘Antecedents certificate’; 

• A copy of the foreign national’s passport (only the identity details and stamped pages);

• The completed appendix ‘Direct debit collection’;

• The appendix ‘Engagement letter’ from the employer, as completed, showing the details of the current employment at the employer established outside the EU, the transfer and the details of the position and reward at the Dutch employer.

 

If the antecedent’s certificate is not signed and/or if the foreign national has not declared that he or she has no antecedents: 

• The antecedents certificate.

 

In the event that the foreign national is a trainee employee, please add the following to the application: 

• Diplomas and degree certificates; a copy of a master’s degree if applicable; 

• A trainee agreement. 

The aforesaid relates to the preparation of the prospective position within the company or the group of companies, together with a description of the trainee program. The description shows: - that the aim of the residence is to provide training to the trainee employee to develop a career or to provide training in relation to techniques and methods of the corporation. - the duration of the agreement; - the way in which supervision of the trainee employee is carried out during the transfer.

 

Biometric information (fingerprints, passport photo) and signature. 

The foreign national must have his fingerprints and facial image (passport photo) taken to determine his identity. The biometric information is also required to create a residence permit. For the residence permit, the IND also needs a signature of the foreign national. See the appendix ‘Fingerprints, passport photo and signature’.

Regular sponsor

Before submitting an application for a permit, the necessary documents and paperwork must have been collected. Foreign documents must have been legalized and translated too. Bear in mind that this can take some time. It also costs money.

A sponsor needs to add the following documentary evidence to the application: 

• A copy of the passport of the foreign national (only the pages showing the identity details and stamped pages); 

• The appendix ‘Engagement letter’ from the employer as completed, showing the details of the current employment at the employer abroad, the transfer and the details of the position at the Dutch employer; 

• The appendix ‘Declaration of intent to undergo a TB test’ as completed; 

• The appendix ‘Antecedents certificate as completed by the foreign national; 

• The appendix ‘Declaration by a sponsor (employment)’ as completed and signed; 

• The Curriculum Vitae of the foreign national showing what training courses he has completed and - if applicable - the working experience of the foreign national. Upon the performance of a regulated profession, please add the following to the application: 

• Proof of acknowledgement of the professional qualifications. 

 

In the event that the foreign national is a trainee employee, please add the following to the application: 

• Diplomas and degree certificates; a copy of a master’s degree if applicable; 

• A trainee agreement.

Fill out the Antecedents certificate appendix and submit this appendix together with the application.
